These Terms of Service ("Terms") govern your access to and use of OhHeyWow (the "Service"), operated by OHHEYWOW LLC ("OhHeyWow," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
OhHeyWow is an 18+ service. You must be at least 18 years old to create an account or use the Service. By using OhHeyWow, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
We ask for your date of birth when you create an account and will refuse the signup if it shows you are under 18. Giving a false date of birth is a breach of these Terms, and we may suspend or close any account we believe belongs to someone under 18.
OhHeyWow lets Creator accounts broadcast live video and receive money from viewers through one-time tips and recurring subscriptions, and lets any account subscribe to a platform-wide plan. Live video is delivered through a third-party video infrastructure provider; payments, subscriptions, and creator payouts are processed through a third-party payment processor. We do not store your payment card details ourselves.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate account information and to keep it up to date. Notify us promptly at our contact page if you suspect unauthorized use of your account.
OhHeyWow is a mainstream platform. You may not stream, post, or transmit content that is sexually explicit or adult in nature, illegal, infringing, hateful, harassing, violent, or otherwise in violation of applicable law. You are solely responsible for the content you broadcast or submit. We may remove content, suspend a stream, or restrict your account for violating this policy, with or without notice.
Tips are one-time payments and are generally non-refundable. Creator subscriptions and platform subscriptions renew automatically until canceled; you can cancel at any time from your account, and cancellation takes effect immediately rather than at the end of the current billing period, so no partial refund is issued for the remaining period. We deduct a platform fee from tips and creator subscription revenue before it reaches a creator's payout account; the remainder is paid out through our payment processor's hosted payout system, which requires the creator to complete identity verification. We are not a bank, and payout timing is subject to our payment processor's own policies and any verification it requires.
How the platform fee is calculated. Our platform fee is a percentage of the amount paid, set per creator and currently between 5% and 15%. For tips and gifts, which are paid from an existing token balance, that percentage is the whole of what we deduct.
Creator subscriptions are card payments, and card payments cost money to process. For subscriptions only, we additionally deduct the payment processing cost for that transaction before the remainder reaches the creator. That cost is charged to us by our payment processor and is passed through at cost; we do not mark it up. Because part of the processing cost is a fixed amount per transaction rather than a percentage, it represents a larger share of a lower-priced subscription than a higher-priced one.
The effect is that our own fee is the stated percentage in both cases, and the processing cost of collecting a subscription payment is borne by the transaction rather than absorbed by us. A creator's share of a subscription is therefore lower than their share of a tip of the same amount. Current rates are shown in your creator dashboard before you enable subscriptions, and we will give notice before changing them.
Merch and event tickets work the same way as subscriptions. These are also card payments, made directly to the seller through our payment processor. We deduct our platform fee — the same percentage described above — plus the card processing cost for that transaction, passed through at cost with no markup. Unlike subscriptions there is no additional recurring-billing fee, since these are one-time charges rather than a subscription our processor bills monthly. If a creator cancels a ticketed event, every buyer is refunded in full, including our own fee — a cancelled show is not a service we rendered, so we do not keep our cut of it.
Tokens are prepaid credit you buy with real money and spend inside OhHeyWow — mainly on tips and gifts to creators. There are two kinds, Gold and Silver. They are worth the same amount; the only difference is that spending Silver earns experience points at double the rate. Silver becomes available to an account after $1,000 of lifetime spend.
What a token is worth. Tokens are sold at 97 tokens per $1.00, with a minimum purchase of $5.00. When tokens are converted back to money they are valued at 100 tokens per $1.00. The difference — about 3% — is retained by us and is how we are paid for operating the token system. In practice, $10.00 buys 970 tokens, which are worth $9.70 if later withdrawn.
Tokens do not expire. There is no inactivity period after which a balance is reduced or removed, and we do not charge a fee for holding a balance.
Token purchases are not refundable. Once a purchase completes, the tokens are credited to your balance and we do not reverse the charge on request. You can withdraw an unspent balance as money instead, subject to the paragraph below. This does not affect any rights you have under the law of your jurisdiction that cannot be waived.
Withdrawing a balance.You can withdraw at any time, with a minimum of $1.00 worth of tokens per withdrawal. Withdrawals are paid through our payment processor, which requires you to complete its own identity verification before it will pay you. Money that has recently arrived in your balance is subject to a holding period — currently 48 hours — before it can be withdrawn, and payout timing after that is subject to the processor's own schedule.
We are not a bank. A token balance is not a deposit. It earns no interest, it is not insured or guaranteed by anyone, and it is not a claim on us for anything other than use of the Service and the withdrawal right described above.
The Community Chest is an account we operate that collects certain referral commissions and periodically pays part of what it holds to users, ranked by our leaderboards.
Where the money comes from. It is funded by referral commission that has no eligible recipient — see the Referrals section below. If you have opted into the referral programme and there is no eligible person above you in your referral chain, the 5% that would have gone to them goes to the Community Chest instead. There is no separate charge for the Chest and no entry fee.
How it is paid out.The balance is currently split 50% to a prize pool and 50% to operating costs. The prize half is distributed across leaderboard categories and, within each, across ranked positions — currently the top 10 places. Payouts are made in Gold tokens, not cash, and land in the recipient's balance where the withdrawal rules in the Tokens section apply. Payouts happen on a monthly and annual cycle and are executed by us rather than automatically.
The split and the number of places paid are settings we control and may change. Leaderboard position depends on activity on the Service, and some leaderboard categories measure spending — so spending more can improve your ranking in those categories. We do not guarantee that anyone will receive a payout in any period.
You can invite other people to OhHeyWow with a referral link. The referral programme is optional and off by default — you are not enrolled unless you turn it on in your settings.
It works in both directions, and that is the deal. If you opt in, you receive 5% of what the people you referred earn on the Service, and whoever referred you receives 5% of what you earn. If you opt out, neither happens: nobody takes 5% from you, and you receive nothing from people you referred.
Commission is taken out of the earner's own share, not added on top of what a fan pays, and not taken from our platform fee. If you have opted in but nobody above you in the chain is eligible to receive it, your 5% goes to the Community Chest described above rather than staying with you.
We may change the rate or end the programme. Commission is paid in tokens and is subject to the same withdrawal rules as any other balance.
You may stop using the Service at any time. We may suspend or terminate your access to the Service, at our discretion, for violating these Terms or our content policy, or for any other reason with or without notice.
If you believe content on OhHeyWow infringes your copyright, file a notice through our DMCA notice form. A valid notice identifies the copyrighted work, where the infringing material appears on OhHeyWow, and your contact information, and includes a statement made in good faith and under penalty of perjury. Content identified in a valid notice is removed, and the account that posted it is notified and may file a counter-notice.
Accounts against which we have removed content under repeated, valid copyright notices may have their access to the Service suspended or terminated.
The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, OhHeyWow is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, or for content broadcast by other users.
OHHEYWOW LLC is a Wyoming limited liability company. These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.
Nothing here takes away consumer-protection rights you have under the law of the place you actually live, where those rights cannot be waived by agreement.
We may update these Terms from time to time. We'll update the "Last updated" date above when we do. Continuing to use the Service after changes take effect means you accept the revised Terms.
